Tier 2 Sponsor (Work Permit)

Failing to comply with immigration law can have severe repercussions for your business. In the UK and EU, employers are under a duty to prevent illegal working. While this sounds simple in theory, in practice it can be much more challenging.

Employers in the United Kingdom can be sent to jail for 5 years and pay an unlimited fine if they are found guilty of employing someone who they knew or had ‘reasonable cause to believe’ did not have the right to work in the United Kingdom.

Tier 2 Sponsor Duties

Complygate HR Software provides UKVI (Home Office) Tier 2 Sponsor compliance assistance to equip your business with the tools necessary to maintain compliance. This is a crucial service, which can help prevent you from being penalised. As a UKVI (Home Office) Tier 2 licensed sponsor, companies will benefit directly from migration of talent and Home Office expects businesses to play their part in ensuring that the system is being valued and not abused. This means that all Tier 2 sponsors must fulfil certain duties.

The objectives of these duties are to:

  • Prevent abuse of assessment procedures
  • Capture any patterns of migrant behaviour that may cause concern to UKVI
  • Address possible weaknesses in process which can lead to such patterns
  • Monitor compliance with immigration rules and regulations

Tier 2 Sponsor Scoring System

UKVI (Home Office) uses the following scoring system when deciding whether to grant Tier 2 Sponsor application for a licence or not. UKVI (Home Office) gives a score of ‘met’ or ‘not met’ for the following while considering a Tier 2 Sponsor application:

Human Resource Systems

Tier 2 Sponsors or if you are making an application, you should have systems in place that allow you to know when a Tier 2 migrant has not come around for work, to spot and highlight when their current leave is coming to an end.

Convictions and civil penalties

The UKVI will score you whether you have an unspent criminal conviction for a relevant offence or have become liable for a civil penalty.

Tier 2 Migrant compliance

You should have systems in place whether you are employing any migrant worker, sponsored or not, who is in breach of the immigration conditions for instance - a migrant with leave as a Tier 2 has a promotion, change in job title or change in salary. This should be reported to UKVI within 10 working days.

Employment

You should be able to demonstrate that you offer genuine employment which meets the Tier 2 (General) requirement on skill level and appropriate rates of pay. If a sponsored migrant is absent from work without permission for more than 10 consecutive working days, the sponsor must report this within 10 working days of the 10th day of absence.
